Rapid Land Tenure Appraisal
PREREQUISITE:
  I. OBJECTIVES:

At the end of the session the participants will be able to:
Identify the objectives of conducting Rapid Land Tenure Appraisal;
discuss the process and the role of the BLGU in conducting the RLTA;
Identify potential workable lots

II. RESOURCES:

III. PREPARATION:

The Rapid Land Tenure Appraisal (RLTA) is one of the first activities to be undertaken before the project management decides to enter into a project site municipality. It is  conducted in all target barangays by the Systematic Adjudication Team. The purpose of the RLTA is to determine the approximate workable lots in a barangay and the level of interest and participation of the Barangay Local Government Unit.

Before proceeding further let us have a clear understanding of the Important definitions used in this lesson.:

No. of potential lots -
refers to the total number of untitled lots as projected in the Cadastral Index Map and from the validated record from the CENRO as to the status.
No. of Workable lots - refers to the total number of agricultural untitled lots. This excludes lots with disputes that have been registered in the court, lots that require segregation and /or subdivision surveys, and lots with disputed titles.

IV. PRESENTATION:

A. Objectives of RLTA

The Rapid Land Tenure Appraisal is the process to obtain a clear picture of the land tenure situation on the ground before operations are entered into. Local knowledge of Barangay members are tapped to acquire reliable information about land tenure in the area. This process also provides a mechanism to better direct land titling field operations to meet the tenure needs of the local community and thereby strengthen efforts towards tenure security.

Specifically,

1. It is  intended to determine the approximate workable lots in a particular barangay;

2. To generate  interest of the concerned BLGU to support the implementation the land titling project;

3.To provide  SAT to observe the distribution of residences and subdivisions in the area;

4.To improve decision making and provide more focused social development activities.

The output from this activity is a plan on how best to enter and commence systematic adjudication in the area..

B. STEPS IN CONDUCTING RLTA

1.Meet with the key Municipal Officials  to:

- inform the BLGU about the conduct of Rapid Land Tenure Appraisal; and
-arrange schedule for the conduct of the RLTA Orientation.

2. Confirm the schedule of the RLTA Orientation with the Municipal Mayor.

3. Prepare barangay maps.
a)Access copies of the Consolidated Cadastral Maps (CCMs) from the CIM Unit.
b)Prepare a map for each barangay utlising the consolidated cadastral index maps, the records from the Parcel Masterfile, from the CENRO, DAR and from the Municipal Assessors Tax Map Control Roll.
c)The maps must show all the lots in the barangay and a color legend to indicate information gathered rerlative to  workable lots.

4. Prepare presentation of materials for Rapid Land Tenure Appraisal      Orientation
a)Provide each barangay with a plastic attaché case containing the programme for the day, a copy of the power point presentation providing an overview of LAM, an explanation of the Map legend, an explanation of terms used on the top of the recording sheets, pen, highlighter and table of potential lots.

5.  Orient  Barangay officials on RLTA
a)Present  the rationale and objectives for undertaking the Rapid Land Tenure Appraisal and a definition of terminologies;
b)Discuss the map (CCM) and how to use the CCMs.
c)Train Barangay representative on how to Accomplish RLTA Form
1)In Column 1- Lot No. - enter the lot number appearing in every parcel as provided from the DENR land records;
2)In Column 2 -  Survey Claimants - enter the name  of the parcel claimants,  that were identified during the cadastral survey (1975) and may not be the same as the current owner. Names are provided in order to guide in identifying the lot in the map;
3)In Column 3 - Current Land Owner -  Write down the current owner of the lot;
4)In Column 4 - Indicate whether the owner is residing within the barangay, municipality, or outside the municipality;
5)In Column 5 - Indicate “Y” if the owner has known contact details and “N” if contact details are unknown
6)In Column 6 - Ask respondents if there is any title. If none, put “N”, if yes, put “Y”;
7)In Column 7, put a check in the column, if there is an official document proving title.
8)In Column 8 - Explain why lots were subdivided (portion of the lot has been sold, donated, traversed by road, divided among heirs)
9)In Column 9 - put a check in the column  if the lot has been informally subdivided (no approved subdivision survey),
10)In Column 10 - put a check on the column if the lot has on-going case in court.
11)In Column 12 put a check if the respondents is interested to apply for title
12)Column 13 Name & signature of the informant

NOTE:
After explaining how to accomplish the table, DO A ROLE PLAY where the barangay rep act as respondent  and the SAT MEMBER as the Apprariser.

Seek feedback from the barangay reps on the process and difficulty they
anticipate in the field.

Furnish the barangay reps with the kit to include the 3 CCIM, 3 tables, pens, coloring material, pink highlighter,  and tubes.
d. Identify the lot owner using the Cadastral Consolidated Map (CCM) .

1)Explain that colored lots are those lots that we already identified  and the brgy. representative need to focus on those lots without color.

2)Explain the map and the legend (use color coding)
I.Titled lots - are patents, CLOAs or decrees registered with the Register of Deeds (ROD)
II.DAR coverage - parcels that were turned over to DAR for Certificate of Land Ownership\ Award (CLOA) or Emancipation Patent (EP) issuance
III.Applied lots - parcels covered by applications with the Bureau of Lands or filed with the court(in process)
IV.Patented lots - those lots with approved applications but still unregistered
V.Lots with CSD - those lots with approved Cadastral Subdivision Survey Lots with PSD - those titled lots with approved subdivision survey undertaken by the owner
VI.Lots with pending or on-going cases in court or at the CENRO
VII.Residential lots - non-agricultural lots with a residential classification as defined by the Municipal Assessor

NOTE:

6. Monitor the conduct of Rapid Land Tenure Appraisal
a)SDO to oversee the validation process in the field;
b)SDO to conduct a weekly monitoring by having an actual visit and one-on-one discussion with the concerned barangay Officials
c)Purpose of the monitoring was to give inputs to the barangay Officials on the correct way of conducting the activity and to have an initial assessment of the progress of each barangay

7. Collect RLTA  output from the BLGU and assess  its reliability and accuracy.
a)SDO to facilitate the collection of the RLTA results per barangay through a meeting with the concerned barangay council members who are involved in the activity.
b)Facilitate initial assessment of the quality of the data gathered using the set of questions below:

C. Procedure to Determine the Level of Interest of the Barangay Local Government Unit (BLGU) to Support the Project Implementation Based on their Participation in the RLTA.

1. Assess the concerned BLGU based on their performance during the actual conduct of the RLTA using the criteria below:

Indicators:
a)The number of BLGU officials involved during the conduct of the Rapid Land Tenure Appraisal in their barangay;
b)The ability of the BLGU officials to meet deadlines for the submission of the RLTA results;
c)The quality and accuracy of output based on the set criteria;
d)Percentage of lots validated compared with the total number of lots of the barangay;
e)The strategies employed by the BLGU in completing the task specially in reaching out thenon-residents land claimants

     2. Prioritize the barangays based on the result of the RLTA vis-à-vis the level          of interest shown by BLGU using the suggested criteria below:

Priority 1: Barangays with high workable lots and with high level of BLGU
                  participation;
Priority 2: Barangays with low workable lots but with high level of BLGU
                  participation;
Priority 3: Barangays with high workable lots but with low level of BLGU
                  participation. Suggested alternative strategies for this kind of
                  situation:
a)Set a meeting with key municipal officials such as the Municipal Mayor, LGU Focal Person, responsible Sangguniang Bayan member and the concerned Barangay Officials. Discuss and clarify the following agenda:
I.Identification of the problems and reasons for non-
II.participation by the BLGU;
III.Get the commitment of the concerned barangay officials or the final decision of the BLGU whether to support the project or not;
IV.Ensure proper documentation of the agreements
V.Inform management decision about the result of the discussion
Priority 4: Barangays with low workable lots and low level of BLGU
                  participation
a)Initial identification of potential Barangay Information Officer should also be facilitated during this stage for formal appointment by the Barangay Council during formal entry to the barangay.

V. FOLLOW-UP

1. Describe the RLTA activity
2. Explain the guiding principles in the conduct of RLTA
3. Discuss the procedure in determining the level of commitment of the LGU.
4. Describe the criteria in prioritizing the a bartangay according to the level of      interest
5. Accomplish land tenure validation table.
6. Participants will be organized into teams of validators. They will be provided with the areas to cover and accomplish the RLTA form.
