Lesson Plan
PREREQUISITES:
Conduct of RLTA
Municipal Engagement and Partnership Building
I. OBJECTIVES:
At the end of the session the participants will be able to:
1)Identify the objectives of community mobilization;
2)Name the guiding principles in community mobilization;
3)Secure commitment of barangay council, purok leaders and BIMO to support land titling program.
ii. RESOURCES:
a)Briefing Kit for distribution to participants
b)LCD Projector and computer, if available
c)Banners, visual aids and audio-visual film, if available
d)In the absence of a venue big enough to accommodate the Assembly, conducting the meeting in clusters (of sitios) may be considered
IIi. PREPARATION:
After the establishment of a Systematic Adjudication Field Office (SAFO) in the area, Community Mobilization begins for Systematic Adjudication (CMSA). This process is accomplished in three phases of land titling activities in selected barangays: 1) building of partnership with the Barangay Council; 2) conducting Systematic Adjudication (SA) or Conducting Simultaneous Survey and Adjudication (SSA); and 3) conducting land tenure improvement planning and Project exit meetings.
This lesson presents community mobilization procedures for the first and third phases, or the pre-adjudication and post-adjudication activities. The lesson will also cover the objectives, principles and output of the community mobilization process
III. PRESENTATION:
A. SOCIAL DEVELOPMENT PRINCIPLES OBSERVED IN SYSTEMATIC
ADJUDICATION
The mobilization of communities in SYSTEMATIC ADJUDICATION fulfills the social development principles of INCLUSIONCOHESION AND ACCOUNTABILITY.
By INCLUSION - mean that all holders of land rights (regardless of sex, religion, educational attainment, etc.) are identified and duly recognized, and are given the opportunity to participate in the land titling process. Engaging our barangay officials, who have best knowledge of the people and land tenure situation in the community, can ensure inclusivity of the land titling processes.
By COHESION, mean, the participation and convergence of human and material resources of the Barangay Council in a systematic manner builds a strong bond of relationship among the community members.
By ACCOUNTABILITY - we mean the provision of opportunities to people to air their concerns, apprehensions, and grievances as they actively participate in the land titling process.
A. Objectives of COMMUNITY MOBILZATION FOR SYSTEMATIC ADJUDICATION (CMSA)
The general objective of CMSA is to establish and operationalize the arrangements and processes for the implementation of land tenure improvement in the barangay. Specifically Barangay Officials are engaged to:
1)facilitate the initial identification and ensure claimants of untitled alienable and disposable lands in the barangay that their rights are properly recognized in the issuance of patents;
2)mobilize people’s participation in titling and post-titling activities;
3)raise the awareness of land claimants about land rights (including women’s rights and tenancy rights), land titling procedures and requirements, and land dispute resolution processes;
4)identify individuals or groups (e.g., women, mortgagors, mortgagees, tenants, leaseholders, indigenous peoples, etc.) who can be adversely affected by the land titling process, and undertake measures to prevent the negative effects;
5)validate community-generated information vital to project implementation;
6)set up the convergence mechanism in the barangay or municipal/city in pooling available resources of government, non-government organizations and private sector to make the possession of land titles an instrument of socio-economic development.
B. Guiding Principles
It is a fact that people in our barangay act on the basis of self-interest and felt needs. It is extremely necessary that the LGU’s and the national government must inform and make people fully aware the of the beneficial effects of the land titling project.
1)People feel powerless and withdraw if they perceive the endeavor to be requiring resources beyond their means. It is therefore important to present the requirements of participation-by barangay officials and land claimants-in a simple, understandable, and realistic manner.
2)People tend to give importance not only to words but also to actions of implementers. SAFO staff should then be sensitive to the way they relate with (verbal and non-verbal) the people.
3)Land ownership is traditionally associated with men. To ensure that the program does not exacerbate gender gaps in families and communities, it is important to be sensitive and responsive to gender issues.
4)It is important to have in mind the “Real Pareto maxim,” which states that “justice is so important that we should never make the worse off even worst off (however trivially) for the sake of others” (Wolff, 2001). The program should thus be sensitive and responsive to the potential adverse impact of the project on the poor and marginalized.
C. EXPECTED OUTPUTS
The CMSA when conducted planned must produce the following outputs:
1)A barangay resolution and a Memorandum of Partnership Agreement (MOPA between the Barangay Council and the LGU through the barangay chairperson and SAT Leader for a collaborative implementation of the land titling project;
2)Barangay Information Center is established and Barangay Information and Monitoring Officer (BIMO) identified and appointed;
3)Barangay Council, Barangay Information and Monitoring Officer (BIMO), and Field Systematic Adjudication Team understood their respective roles and responsibilities in the implementation of
4)List of land claimants verified and their claimed lands identified;
5)Men and women claimants and non-claimants of the barangay are aware of their land rights, responsibilities and commitment to participate in titling project;
6)Barangay land tenure profiles are developed and validated at the barangay level;
7)Detailed Operations Plan prepared collaboratively with the Barangay Council;
8)Land disputes are referred to the assigned adjudicator for resolution. if not resolved, it is forwarded to the Lupong Tagapamayapa
9)Barangay Assembly conducted and people were aware of the schedule and detailed survey and land titling activities (from monumenting, preparation of respective lots for survey, etc.)
10) Barangay and Municipal/City government officials were aware of the use of the Land Tenure Profile in local development.
The mobilization of the community in the land titling project happens in: 1) pre-adjudication; 2) during the Systemaytic Adjudication or Simultaneous Systematic Adjudication; 3) post adjudication phases.
PRE-ADJUDICATION
1. Conduct exploratory meeting with the Barangay Captain.
This is the SAT’s first formal visit and meeting with the Barangay Captain on Systematic Adjudication, to explore the possibility of a
partnership in the implementation of the land titling project.
In this meeting the team introduces the land titling project objectives, benefits, roles and responsibilities of the barangay council. It is hoped that after meeting the barangay captain confirms the barangay’s acceptance of the undertaking and agreement on the schedule of Orientation Meeting is secured from the barangay captain.
The following will be the prescribed detailed talking points during the exploratory meeting:
a)A Project objectives and components
b)Advantages of the land titling Project
c)Facilitation of an efficient and low cost titling of untitled alienable and disposable lands in the barangay
d)Referral of tenant and leaseholder issues to the Department of Agrarian Reform (DAR) for clarification and action
e)Responsibilities of the Barangay Council:
f)Activation of the Lupong Tagapamayapa to handle land disputes that may arise from the land titling activities
g)Adoption of participatory processes in project planning and implementation
2. Conduct orientation and commitment meeting with the Barangay Council, Purok Leaderes and BIMO
The objective of this meeting is to inform the participants about the land titling project and elicit their commitment to actively support and participate in the implementation of the project.
The following talking points are prescribed for presentation during the orientation meeting:
a.Objectives, Components and procedures of the Project
b.Advantages of the land titling project
c.Importance of the active support of the Barangay Council to the successful implementation of the project
d.Proposed functions, roles and responsibilities of the barangay council and SAFO. The Barangay Council may have the following roles and responsibilities:
-Mobilize land claimants’ participation in land titling activities, such as monumenting, Simultaneous Survey and Adjudication (SSA), adjudication, follow-up of lacking documents
-Moderate the education and information dissemination activities on tenure rights, the project and implementation schedules
-Collect documents from land claimants and submit them to Systematic Adjudication Field Office (SAFO)
-Activate or strengthen the Lupon Tagapamayapa for the resolution of land disputes and grievances (See Module 12 Dispute and Grievance Resolution on assistance to be provided by the Project)
-Pass necessary legislation in support of land management and tenure improvement
-Coordinate with the Municipal Agrarian Reform Officer to facilitate the registration of tenancy and leasehold rights
-Identify land tenure issues or concerns in the barangay that can affect the Project implementation
-Assist in securing free, prior and informed consent (FPIC) of Indigenous Peoples/Indigenous Cultural Communities, if necessary
-Assign a barangay representative per territory for the validation of RLTA, mobilization of claimants, and all other project activities in each territory
e.Mechanics and terms of partnership
-Issuance of a Barangay Council Resolution for the acceptance of the Project;
-Forging of a Memorandum of Partnership Agreement (MOPA) between LAMP SAFO and the Barangay Council detailing the commitments, roles and responsibilities of the Barangay Council and the SAFO
-Assigning of a Barangay Information and Monitoring Officer (BIMO)
-Discussing timeline for adjudication activities
f.Apprehensions of the Barangay Council towards the project and possible hindrances, if any
g.Availability of preliminary data on the barangay
h.Discuss and organize the putting-up of information posters and materials in strategic locations; and the setting up of a Barangay Information Office

3: Validate Initial list of Land Claimants and Land Tenure Profile
` Gather data on the claimants of untitled alienable and disposable (A&D) lands and non-claimants who have stake in the land in the barangay to review the initial data.. These data will be used as basis for planning land titling activities in the barangay and as baseline for Monitoring and Evaluation (M&E).
This step is also used as an opportunity to disseminate information about the Land Title Project among barangay residents; and to know and build rapport with claimants of untitled A&D lands and with non- claimants who might be affected by the land titling project.
PROCEDURE:
Convene the Barangay Council and key informants in a meeting, to discuss the prescribed agenda:
a.Explain that the objective of the meeting is to review and validate the initial list of land claimants and Land Tenure Profile;
b.Assign a territory to a councilor and key informants. Give to each councilor his/her territory map.
c.Let the Councilor and key informants review and validate the data on parcels of land in their assigned territory;
d.After the meeting, the CDO and CDA assess the quality of the initial output of the validation and conduct a ground validation of selected lots to ensure accuracy of information and improve the quality of the Initial Land Tenure Profile;
e.Prepare summary profiles and a validated list of claimants to take to the Barangay Assembly for verification with land claimants.
4. Prepare Operations Plan for Barangay Assembly and Systematic
Adjudication
The objective of Operations Planning Meeting with the Barangay Council is to develop a detailed plan for:
a)Mobilizing land claimants (both for residents and non-residents) to attend the Barangay Assembly and participate in the adjudication of their lands
b)Conduct of interviews and ocular inspection (for surveyed barangays); or for schedule of monument preparation, monumenting of lots and interviews (for unsurveyed barangays)
c)Handling land disputes that may derail the land titling process.
5. Send invitation to land claimants and non-claimants to attend the
Barangay Assembly.
a)Use territory maps as basis for the division of tasks so that the barangay council may not be overwhelmed with the demands of inviting claimants and non-claimants.
b)Define the possible methods for disseminating information, e.g., sending of notices, one round of house-to-house visitations to explain the contents of the notices and the importance of the Barangay Assembly, another round of house-to-house visitations to confirm attendance, and bandillo a day before the Barangay Assembly.
c)Remind the assigned individuals to ensure that both women and men of households of land claimants, as well as their tenants if any, are informed about the Barangay Assembly.
d)Set the schedule of the Barangay Assembly based on the availability of the large majority of claimants and non-claimants (i.e., the Project should be open to holding the Assembly on a weekend).
6. Conduct Barangay Assembly
The Barangay Assembly is the first opportunity for parcel claimants and non-claimants to receive a comprehensive orientation on land titling project.
This activity marks the end of the pre-adjudication process and the beginning of adjudication in surveyed barangays. The objectives of the Barangay Assembly are:
a)Raise or enhance community awareness on the Project;
b)Surface and respond to fears and reservations about the Project;
c)Verify the list of claimants;
d)Announce the activities and schedule of the adjudication process;
POST ADJUDICATION
1. Conduct Barangay Exit Meeting
From the earliest stages of engagement with the barangay, it must be clearly recognized by the barangay that SAT shall exit once systematic adjudication has been completed. However, the barangay must be prepared and informed on how and when the exit will occur. For this purpose, the Community Development Officer and Community Development Assistant shall set a meeting with the Barangay Council.
The Objectives of the Barangay Exit Meeting are:
a)Report to the Barangay Council the progress and gaps of the systematic adjudication process; and
b)Plan with the Barangay Council the necessary measures for the completion of the systematic adjudication process and activities after the adjudication process.
Procedure
The Barangay Exit Meeting shall cover the prescribed agenda as follow:
a)Updated land tenure profile (Form 1: Land Tenure Profile and Form 2:Summary of Land Tenure Profile)
b)Progress and gaps of the adjudication process (also use Barangay Exit Report: Sheet 1 and Sheet 2)
c)Factors that hindered some claimants from applying for patents, and other issues encountered during the adjudication process (Form 4: Barangay Stakeholder Analysis)
d)Actions that the Barangay Council have taken and can still take to assist in the completion of the systematic adjudication process (Form 6: Checklist of Barangay-level Activities)
e)Schedules of the adjudicator for the remaining lots for adjudication
f)Schedule of the Municipal Exit meeting, where the land tenure profile of the barangay shall be turned over.
Documents (i.e., all accomplished SD Forms and Barangay Exit Report Sheets) shall be turned over to the Barangay Council after the completion of the systematic adjudication process or during the Municipal Exit meeting.
