Learning Module
MODULE DESCRIPTION:
This module introduces the participants to the importance of Municipal Engagement and Partnership-building in implementing land titling project in a municipality. Topics on partnership building processes are included to facilitate understanding.

GOAL OF THE MODULE:
The primary goal of this module is to provide the participants with a general understanding of engaging the local government in land tenure improvement.The objectives of building partnerships; roles of local government and strategies are included. This introduces the participants to the necessary elements in building partnerships.

LEARNING OBJECTIVES:
At the end of the module the trainees will be able to :

          a) Identify objectives of building partnership
          b) Identify activities jointly undertaken by the MLGU and PENRO/SAFO
         c) Describe the MLGU role in Implementing the new land titling processes
          d) Explain the strategies/.activities in building partnerships

LEARNING CONTENTS:

1. Importance Of Municipal Engagement And Partnership Building

          a) Gain the commitment of the LGU to partner with PENRO/CENRO in land titling;
         b) Ensure sufficient understanding by the LGU of the project and its benefits;
         c) Clarify the roles and responsibilities of the LGU and PENRO/CENRO in titling
              operations;
          d) Prepare a municipal operations plan with adequate participation from the LGU and the
              PENRO/CENRO  STAFF;
          e) Confirm the commitment of the LGU in the form of a resolution from the Municipal
              Council; and
          f) Formalize the partnership through a Memorandum of Partnership Agreement (MOPA).

2. Guiding Principles implementing MEPB process:

To achieve success in the conduct of the land titling project, the Implementers must be guided by the following principles:

          a) The principle of mutual trust, sharing of responsibilities and benefits must be adhered
              by the Systematic Adjudication Field Office (SAFO) and the municipality in this
              undertaking land titling in the area;
          b) The LGUs must possess a strong sense of ownership of the project as this would                    
              sustain the partnership; and
          c) With LGU and SAFO as partners, the project goals could be easily achieved.

3. Outputs
:

     The successful conduct of this undertaking is indicated by the following:
          a) An appreciation by the Mayor of what the Project is about, and a manifestation of
              his/her intention to pursue the necessary procedures and activities for Project
              implementation;
          b) Secured schedule for Project presentation from the members of the Municipal Council,
              Department Heads and other relevant offices;
          c) Assignment of a Focal Person from  the LGU by the Mayor, which could either be the
              Municipal Assessor or Municipal Planning and Development Officer;
          d) Enacted resolution by the Municipal Council supporting/endorsing the implementation
              of new land titling technologies;
         e) Signed Memorandum of Partnership Agreement (MOPA) on Project implementation by
              the Project staff and the LGU;
          f) Identified the priority barangays for Systematic Adjudication (SA) or Simultaneous
              Survey and Adjudication (SSA) activities;
          g) Identified and defined Resource counterpart (financial and human resource) from the
              LGU  to support Project implementation;; and
          h) Organized Project coordination mechanism in the Municipal Technical Working Group
              (MTWG) has been formalized.
                         
4.  Steps in municipal Engagement and Partnership Building

     Step 1: Meeting with the Local Chief Executive

      A meeting with the Local Chief Executive signals the start of the MEPB Process. This is the second meeting (the first was prior to the initial engagement) with the local official. The objective is to reintroduce the project ,explore and further strengthen  the possibility of implementing the project in the municipality.

          1.1. Send a formal communication to the Municipal Mayor seeking an appointment for a          
                 Presentation meeting to identify possible modes of project implementation (SA and  SSA)
                 and the need to appoint LGU Focal Person.

          1.2. Meet  the Mayor on the scheduled date and time.  The following items of the agenda are
                prescribed for discussion:

          a)  two modes of implementing SA and/ SSA;
          b)  the need for the designation of an LGU Focal Person;
          c)  schedule of project presentation to the Municipal Council and Department Heads;
          d)  Other issues arising from the discussion.

    Step 2: Make Project Presentation to the to Municipal Council and Department Heads.                               
This is the formal presentation to the Municipal Council and Department Heads. The objective is to orient LGU leaders on the mass tilting operations.  It will also serve as the venue for clarifying possible issues and concerns on the Project. The agreements made in this meeting would serve as basis for defining the quality of support to be given by LGU, which would be embodied in a Resolution issued by the Municipal Council.

          2.1) Present the Project using the standard Project Orientation Material.

The orientation material is an hour-long presentation covering the major aspects of project implementation.  The objective is to inform and educate the participants on :
         a) Historical account of land titling in the Philippines
          b) The need for reform in the land administration system
         c) Project  Framework and Project Components (with emphasis on Tenure Security);
          d) Systematic Adjudication (SA) and Simultaneous Survey and Adjudication (SSA) activities;
         e) Requirements for filing Free Patent Application
          f) The One-Stop-Shop (OSS)
         g) Roles and responsibilities of the project staff and LGU
          h) Required counterpart resources from the LGU

                2.2 Open Forum

  Step 3: Sign  Memorandum of Partnership Agreement  (MOPA)

After the Project Presentation to MLGU officials and key staff, the Project Staff proceeds to the process of enacting a Memorandum of   Partnership  Agreement with the MLGU. The MOPA shall be based on      the agreements made in the earlier meeting  with the Mayor and LGU   officials, as well as the Resolution issued by the Municipal Council.

The signing of the MOPA is scheduled and arranged by the project staff through the LGU Focal Person. It requires the presence of the LCE and SAT Manager/CENRO/PENRO (whoever will be designated later) as signatories, and key officials from both parties as witnesses.
The recommended provisions of the MOPA are:

          a) Agreements between the LGU and PENRO/CENRO/SAFO on the rights, responsibilities and
              benefits in undertaking the titling project;
          b) Resources to be provided by PENRO/CENRO/SAFO, and the counterpart resources to be
              provided by the LGU;
          c) Management and administrative arrangements; and
          d) Provisions for Exit and Sustainability.

Step 4: Conduct Operations Planning with MLGU

Following the signing of the MOPA, the Project now schedules the conduct of Operations Planning with MLGU officials and staff. This activity aims to develop jointly a Workplan for the implementation of the Project in the identified barangays, finalize implementation arrangements and resource commitments between the LGU and PENRO, and address other concerns on Project operations. The following are considered in the plan:

          a) Review of the land titling procedures;
          b) Review of the LGU Approved Proposal for Survey or Titling Project;
          c) Identify priority  barangays for SA/SSA operations based on prioritization criteria (i.e., potential
              lots, geographical setting, accessibility, peace and order situation);
          d) Finalize  counterpart allocation (funding, human resource and others) from the LGU;
         e) Prepare chedule of activities for project operations;
         f) Plan for agency Convergence;
         g) Establish M&E arrangements between project staff and LGU;
          h) Identify coordination and linkage mechanisms for Project updates, issues and concerns;
         i) Scheduling of other relevant activities (e.g., Project launching);

Step 5: Conduct Barangay Land Tenure Improvement Planning Workshop

This is a Planning Workshop for a cluster of 15 barangays. The number of planning workshops will depend on the number of clusters of barangays in
a municipality.
The General Objective of the Planning Workshop is to promote barangay and municipality-wide actions that shall improve land administration and management towards greater local investment and better access to development opportunities and social services.

Specific Objectives include:

a) Analyze the socio-economic and land-tenure conditions in the municipality and barangays, and identify  issues that can be resolved to maximize the benefits of land titles;

b) Develop municipal and barangay plans of action to resolve issues; and

c) Identify resources of the LGU, national government agencies, civil society organizations and private sector organizations that can be tapped for the implementation of the action plans.

5.1  Identify barangays that can be grouped together. Grouping can be based on common crops or geographical location or timing of completion of the adjudication process. There will be a maximum of       15 barangays per planning workshop;

5.2 Invite three officials per barangay (barangay chairperson and two barangay councillors), municipal government officials, and government agencies that can respond to land-related concerns; and

5.3 Conduct the planning workshop using the recommended program.

During the Workshop, the SAT Leader or Deputy SAT Leader and Social Development Officer shall encourage and assist the barangay and municipal government officials to:

a) Appreciate that land tenure problems are located in a broader context of agricultural policies, low productivity, poverty and landlessness;

b) Be interested in land administration and management in the municipality by indicating areas (and using examples) where the LGU can make policy/regulations to improve land use planning, meet merging land use needs (urbanization), reduce the proportion of idle land, etc;

c) Take an interest in landlord-tenant relations and how they impact on agricultural production and local economic growth;

d) Use the barangay land tenure profiles as input and resource for barangay and municipal development planning;

e) Work with barangays to develop their Barangay Land Tenure Improvement Plans and incorporate these plans to the Municipal Development Plan by looking for issues common to a number of barangays that might be addressed by a municipality-wide approach;

f) Consider ways of increasing own source revenue in order to meet development needs that are beyond the internal revenue allocation (IRA) development budget fund;

g) Seek out existing and potential service providers, donors, NGOs and private sector interested to partner with the LGU in creating employment opportunities, implementing development projects, improving agricultural practices, diversifying livelihood options etc.

h) Activate committees and structures that provide for interagency action and coordination on initiatives; and

i) Set up monitoring and evaluation mechanisms to assess the implementation of the land tenure improvement plans.

Step 6: Conduct Municipal Exit Meeting

The Municipal Exit Meeting is conducted when all adjudication activities in the municipality and all clusters of barangay land tenure improvement planning workshops have been completed.

In this Meeting, the SAFO presents:

a)  the land tenure situation of the municipality after adjudication and the remaining challenges;
b) explains the potential uses of the land tenure profile in steering the development of the area; and
c) encourages representatives of stakeholder groups to pursue this development  by forming or strengthening a convergence mechanism.

To be invited in this activity are the:

a) Mayor, Municipal Council,
b) three (3) representatives of each Barangay Council,
c) representatives of concerned government agencies (CENRO, DAR, Department of Agriculture), and representatives of civil society organizations.

The General Objective of the Meeting is to:

a) Formally end the Project in the municipality; and
b) Turn over the responsibility of sustaining Project gains to the Municipal Development Council, which is a local special body headed by the Mayor and composed of representatives from various departments of the LGU, representatives of government agencies operating in the municipality, and representatives of civil society and private sector organizations.

The Specific Objectives are:

a) Present the common contents (i.e., land-related issues and actions) of Barangay Land Tenure Improvement Plans;
b) Define municipality-wide actions and mechanisms to support the implementation of barangay land tenure improvement plans;
c) Turn over the responsibility for sustaining land tenure improvement processes to the LGU and other government agencies; and
d) Formalize the exit of the Project from the municipality.

Step 7: Conduct Land Titleholders and Tenants/Leaseholders’ Forum
The Land Titleholders and Tenants/Leaseholders’ Forum convenes all titleholders and tenants covered under project to discuss their land rights and responsibilities, the potential uses of their land titles, and the available resources of government and civil society organizations that can be tapped.

The General Objective of the Forum is;

a)  to link the possession of land titles to available services and
     resources towards land productivity and development.

The Specific Objectives are:

a) Raise the awareness of land titleholders and tenants/ leaseholders on their land rights and responsibilities, and the available services and resources they can tap to maximize the benefits of their land titles; and
b) Link land title holders and tenants/leaseholders to government agencies, non-government organizations, and private sector organizations that can provide assistance for land tenure improvement and productivity.

To be invited in this activity are :

a) Key MLGU officials;
b) Representatives of NGOs and private sector organizations; and
c) Government agencies such as the Department of Agrarian Reform, Department of Agriculture, National Irrigation Authority, National Commission on Indigenous Peoples, etc. 

7.1 Meet with the MLGU Focal Person or Technical Working Group on the scheduled date coordinated  by Social Development Officer to plan for the conduct of the forum. The agenda of the                    meeting  shall be:

a) Schedule and venue of the Forum;
b) List of titleholders and tenants/leaseholders to be invited;
c) Issuance of letters of invitation signed by the Mayor (c/o LGU);
d) Invitation of government agencies, non-governmental organizations and business organizations;
e) Formulation of Program of Activities and identification of facilitators/resource persons for each topic;
f) Agreement on funds-sharing between LAMP 2 and LGU for the activity.

ASSESSMENT :

After this module the participants will be asked to choose any two activities and preside over the conduct of activity. The participant must be able   to demonstrate the activities as defined in this module.

1. Conduct an exploratory meeting with the MLGU
2. Facilitate an operational planning meeting
3. Conduct an exit meeting
4. Conduct a landtitle holders forum
